Terms and conditions of Backyard Bicycles.

2. Scope
These terms apply to all orders, appointments, repair orders, services and other contracts between Backyard Bicycles and its customers, whether consumers or businesses.
3. Formation of contract
a) Online shop
Products shown in the online shop are a non-binding catalogue, not a legally binding offer. Submitting an order constitutes a binding offer to purchase. A contract is formed only when we accept it.
b) Workshop, repairs and service
A contract is formed when the bicycle is handed over, work is commissioned, an appointment is booked or work begins. The terms available when the order is placed are accepted.
4. Prices
Prices are in euros and include statutory VAT where applicable. Additional shipping costs are shown separately during checkout.
Repairs may incur additional costs if further defects, necessary parts or extra work are identified.
5. Cost estimate and quotation
Prices, guidelines or assessments given on site are non-binding estimates based on the visible condition at intake unless expressly agreed otherwise. A complete technical inspection is not always possible at that stage. Defects or additional work identified during repair may result in extra costs.
Written quotation
A detailed or written quotation is available on request and costs €50. It may voluntarily be credited against a subsequent repair order.
Approval threshold
An overrun of up to 20% of the stated estimate is deemed approved. We contact the customer before further work if costs exceed this, where reasonably possible.
6. Payment
The payment methods agreed in the shop or individually apply. These may include PayPal. Workshop services may be paid on collection, in advance or by invoice.
7. Delivery and shipping
Delivery is made within Germany to the address provided. Delivery times are non-binding unless expressly agreed otherwise. Reasonable partial deliveries are permitted.
8. Workshop and repair services
a) Scope of work
Repairs are performed according to the order and the condition identified.
b) Additional work
If further necessary or safety-related work is identified, the approval threshold in section 5 applies.
c) Road safety
We may refuse work or decline to certify a bicycle as roadworthy if significant defects remain.
d) Collection
The bicycle must be collected within 14 calendar days after completion is notified.
e) Standing and storage charges
From the 15th calendar day after completion is notified, the following standing or storage charges may apply:
- Standard bicycle: €2.00 per day
- Cargo bike, special size or trailer: €4.00 per day
Customers may demonstrate that no loss, or a substantially lower loss, was incurred.
f) Uncollected bicycles
If a bicycle is not collected despite notice and a reasonable deadline, we reserve our statutory rights. These include storage charges, enforcement of outstanding claims and, where legally permitted, further steps for storage or disposal.
9. Custom and personalised products
Custom-made, printed or personalised products may show customary variations. The statutory right of withdrawal may be excluded for personalised goods where legal requirements are met.
10. Used goods
Statutory rules apply to used bicycles, parts and accessories. Used goods may show signs of age and use; these are not defects if they were known, described or apparent when the contract was formed.
11. Retention of title
Delivered goods remain our property until paid in full.
12. Transport damage
Please report obvious transport damage to the carrier immediately and notify us promptly. Statutory rights remain unaffected.
13. Warranty
Statutory warranty rights apply.
14. Liability
Our liability is unlimited for intent, gross negligence and injury to life, body or health. Statutory provisions otherwise apply.
15. Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
16. Final provisions
If individual provisions of these terms are invalid, the remaining provisions remain effective.
